Occupational risk

In 1996 several amendments were introduced to the Labour Code. These amendments concern the need to adapt Polish rules and regulations to the requirements of the European Union. One of the changes was the introduction of obligatory "assessment of occupational risk" which is connected with the work performed, and of the obligation to inform workers about occupational risk.

In this situation, employers need to face the problem of how to manage this issue.

What is occupational risk?

According to the definition (the Ordinance of the Minister of Labour and Social Policy from 26 September 1997 regarding general regulations of occupational safety and health - JL No 129, item 844 with amendments):

Occupational risk means the probability of undesirable incidents connected with performed work happening; such incidents can cause loss, especially in reference to workers who can experience negative effects on their health resulting from occupational risks’ agents present in the work environment or from the way of performing one’s work.

When do we make assessment of occupational risk?

The first assessment of occupational risk in the work station should be made before this station is put into operation.

It should be born in mind that the assessment of occupational risk will be made:

» in case of creating new work stations
» after introduction of changes regarding the application of protective measures
» in case of considerable organizational and technological changes
» in case of accident

In order to inform workers about occupational risk, the employer needs to, above all, determine such risk for particular work stations and, depending on the results, take and apply proper protective measures.

What will be the benefits for the employer if the assessment of occupational risk for work stations is made properly?

» requirements regarding precepts of law will be met
» the employer will be aware of existing risks and will know whether undertaken preventive measures are sufficient
» instead of intuition - the level of risk will be managed knowingly
» additional costs and losses will be avoided
